Article 1 – Preamble
Any order implies the buyer’s acceptance of these general terms and conditions of sale, unless otherwise agreed in writing and signed by the seller. Consequently, any contrary clause or condition that may appear on the orders or printed documents of the buyer, or of the buyer’s representative, is null and void and cannot be enforced against the seller unless the seller has formally accepted it by an acknowledgement of receipt sent by fax or e-mail.
Article 2 – Security
Our website is protected by a security system: each buyer must identify themselves with a unique customer number. Un Chat dans l’aiguille cannot be held responsible if a customer discloses their customer number to a third party.
Article 3 – Customer service
For any information or question, our customer service can be reached by e-mail at contact@chatdanslaiguille.fr, or by post at Un Chat dans l’aiguille, 16 rue de Belle Rive 38300 BOURGOIN-JALLIEU, France. Please contact us by e-mail whenever possible, as we can reply faster. Article 4 – Formation of the contract
The contractual information is presented in French and will be confirmed, with all of this contractual information, no later than at the time of delivery. Un Chat dans l’aiguille reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.
Article 5 – Validation
When you click the “Payment” button at the end of the ordering process, you declare that you accept the order and these General Terms and Conditions of Sale in their entirety, fully and without reservation. The data sent to Un Chat dans l’aiguille constitute proof of all transactions between Un Chat dans l’aiguille and its customers. Unless specific terms have been brought to the buyer’s attention, the copy of the order sent to the buyer by e-mail serves as confirmation if no change is made by either party within eight working days.
1°/ The reference or precise description of the item (type, quality, size, colour,…)
2°/ The quantity, for each item
3°/ The price on the day of the order
4°/ The place of delivery and the payment terms.
5°/ The delivery time. Once the above requirements are met, the contract is deemed to be finally concluded as soon as the parties agree on the goods and the price, the seller undertaking to carry out the order and have it delivered to the place indicated by the buyer, and the buyer undertaking to take delivery of and pay for the goods.
Article 6 – Secure payment
Unchatdanslaiguille.fr offers you 3 payment methods:
6.a – By bank card
You can pay directly by bank card (CB, Visa, Mastercard) through our secure OGONE solution. If you choose this option, you are redirected to a secure, encrypted page starting with https (look for the small padlock in your web browser). You can then safely enter the 16 digits of your bank card, its expiry date and its security code.
6.b – With Paypal
You can pay in 3 interest-free instalments with Paypal.
Financial information is never passed on to www.chatdanslaiguille.fr. Paypal encrypts and protects the card number. The customer pays online simply by entering their e-mail address and password. The amount is debited when the order is placed, provided that authorisation to debit the account has been obtained from the relevant payment centre. If payment is not authorised, the order is not made available to the customer.
6.c – Bank transfer (Professionals only)
After choosing this payment method when ordering, you will receive an e-mail with a summary of your order and all our bank details so that you can make your transfer.
Article 7 – Orders
Our product offers are valid while stocks last. Information on product availability is given when you place your online order. However, 2 types of unavailability may occur, which our team would confirm by return mail after receiving the online order:
7.a. Unavailability due to a waiting time at one of our suppliers
7.b. Unavailability due to computer or physical stock errors. As the information on the website comes directly from the online shop management tool distributed by Oxatis, exceptional errors or variations may occur.
7.c. If a product is unavailable after you have placed your order, we will inform you by e-mail or by post as soon as possible. You can then request the cancellation or exchange of your order at contact@chatdanslaiguille.fr or by post at Un Chat dans l’aiguille, 16 rue de Belle Rive 38300 BOURGOIN-JALLIEU, France. Please contact us by e-mail whenever possible, as we can reply faster. You can also reach us by telephone from Monday to Friday (except Thursdays, public holidays and exceptional closures announced on the website home page), from 8:30 am to 12:00 pm and from 1:30 pm to 5:00 pm on 04 74 28 26 36.
Article 8 – Prices
The current Shop prices are shown in euros and may be changed without notice. They are negotiated by contract with suppliers and exclude transport. The order is carried out at the price in force on the day of the order, which is understood as the selling price excluding taxes, ex-shop.
Article 9 – National and international shipping
Selling prices are understood ex-shop. The buyer will be invoiced for the actual shipping costs for each delivery note. Transport and collection costs are borne by the buyer, whatever the arrangement for transport and collection costs (carriage paid or carriage forward).
Article 10 – Shipping conditions
Parcels are usually shipped within 4 to 5 days (excluding weekends) after receipt of payment. Shipping costs include preparation and packaging costs as well as postage. Transport costs vary according to the total weight of the parcel. We recommend that you group all your items in a single order. We cannot combine two orders placed separately, and shipping costs apply to each of them. The boxes are of a suitable size and your items are properly protected.
Article 11 – Delivery terms
Delivery takes place by direct handover to the buyer at the place indicated on the order. Items are shipped by La Poste via Colissimo with a tracking number. Delivery times are given for information only. In the event of late delivery, cancellation of the order can only be requested and obtained after a formal notice sent by the buyer to Un Chat dans l’aiguille after the originally scheduled delivery date and not followed by delivery due to the fault of Un Chat dans l’aiguille, within one month. A justified delivery delay does not entitle the buyer to claim damages. Any delays do not entitle the buyer to cancel the sale, refuse the goods or claim damages. When ordering, the customer must check that the information provided to Un Chat dans l’aiguille is complete and correct. Un Chat dans l’aiguille cannot be held responsible for any input errors and their consequences in terms of delay or delivery error. In this case, all costs incurred for reshipping the order will be borne entirely by the customer. Un Chat dans l’aiguille cannot be held responsible for delivery delays caused by errors or disruptions attributable to carriers (in particular total or partial strikes of postal services, means of transport and/or communications). The consumer must check the condition of the packaging of the goods on delivery and report any damage to the carrier on the delivery note, and to Un Chat dans l’aiguille within three working days.
Article 12 – Delivery problems caused by the carrier
Any delivery anomaly (damage, product missing compared with the delivery note, damaged parcel, broken products…) must be indicated on the delivery note in the form of “handwritten reservations”, together with the customer’s signature. For parcels sent by La Poste, if the parcel arrives open or damaged (in particular with yellow “La Poste” tape), the customer must ask the postman or their post office to draw up a “constat de spoliation” (report of tampering, form 170) and inform Un Chat dans l’aiguille. Un Chat dans l’aiguille makes sure the delivery runs smoothly and, if a problem is found (parcel opened, damaged or lost), the customer must inform Un Chat dans l’aiguille, which will open an investigation and a compensation procedure.
Article 13 : Delivery errors – Non-compliant products
13.a : The consumer must notify Un Chat dans l’aiguille, on the day of delivery or at the latest on the first working day following delivery, of any claim concerning a delivery error and/or non-compliance of the products in type or quality with the information on the order form. Any claim made after this deadline will be rejected without possibility of appeal.
13.b : This claim may be sent to Un Chat dans l’aiguille preferably by e-mail at contact@chatdanslaiguille.fr. Any claim not made in accordance with the rules defined above and within the time limits set cannot be taken into account and will release Un Chat dans l’aiguille from any liability towards the consumer.
Article 14 : Right of withdrawal
All items (except products sold by the metre, made-up or made-to-measure products) may be exchanged or refunded within the legal and contractual time limits.
In accordance with article L221-18 of the French Consumer Code, the customer has a withdrawal period of fourteen days from receipt of the ordered products to exercise their right of withdrawal without having to give any reason.
If the customer exercises this right of withdrawal, the products must be returned in their original packaging, in new condition, with all accessories and instructions, if any. Items returned incomplete, spoiled, damaged or soiled cannot be accepted. Items sold as “do-it-yourself kits” that have been started cannot be accepted either.
Return costs are borne by the customer.
Un Chat dans l’aiguille will exchange the goods or refund the sums paid by the customer for the returned products, excluding shipping costs. The refund will be made within a maximum of thirty days from receipt of the returned products, using the same payment method as the one used for the order.
To make a return, we advise the customer to contact us by e-mail or telephone so that we can recommend the most suitable shipping method for the returned product. This prior contact is not compulsory, however: the customer remains free to exercise the right of withdrawal.
Digital products (dematerialised content)
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied on an intangible medium whose performance has begun with the customer’s prior express consent and express waiver of their right of withdrawal.
Therefore, any purchase of a digital product (PDF file, downloadable pattern, sheet or digital content) accessible immediately after the order is validated cannot be exchanged or refunded.
Article 15 – Payment terms
The customer may pay for their order by any of the methods offered on the website at the time of the order. Please note: pro forma payment is required for any first order. Un Chat dans l’aiguille reserves the right to add or remove payment methods accepted on the website. Un Chat dans l’aiguille reserves the right to suspend the processing of any order and any delivery if payment authorisation is refused by the officially accredited bodies or in the event of non-payment. Un Chat dans l’aiguille reserves the right to refuse to deliver or fulfil an order from a consumer who has not paid, in full or in part, for a previous order, or with whom a payment dispute is being handled. Un Chat dans l’aiguille retains full ownership of the products sold until all sums due by the consumer for the order, including costs and taxes, have been paid in full. Only the original buyer of the goods may rely on the clauses of these general terms and conditions of sale; a transfer of ownership to a third party cannot be handled by Un Chat dans l’aiguille.
Article 16 – Automatic termination clause
If one party fails to perform its obligations, this contract will be automatically terminated in favour of the other party, without prejudice to any damages that may be claimed from the defaulting party. Termination will take effect 7 days after a registered letter with acknowledgement of receipt serving as formal notice has been sent and has remained unanswered. If the customer withdraws from the order or fails to collect the goods sold within the above-mentioned period of 7 days, the contract will be automatically terminated and the deposit will be retained by the seller as compensation.
Article 17 – Receipt of goods
A claim can only be examined if it has first been made by registered letter with acknowledgement of receipt within eight clear days of the date of receipt of the goods. If the claim is justified, the goods will be exchanged or, if this is not possible, a credit note will be issued, without any other compensation.
Article 18 – Product availability
Errors or changes may exceptionally occur regarding the availability of a product. If a product is unavailable after you have placed your order, we will inform you by e-mail or by any other means as soon as we receive it. Your order will be automatically cancelled and you will be refunded immediately if your bank account has been debited. Where applicable, Un Chat dans l’aiguille will offer the customer an equivalent product. The order will be carried out within 30 days at the latest from the day after the consumer’s order was finally validated (payment received and order verification procedure completed). For payments by cheque, the product(s) will be reserved for 4 days, after which they will be put back on sale if the cheque has not reached us.
Article 19 – Force majeure
If the seller duly proves that it is unable to deliver as a result of force majeure or of an unforeseen delay in the delivery of its raw materials or a defective delivery by its suppliers, the sales contract is called into question. In this case, the buyer cannot require the seller to deliver the order on the scheduled date, nor claim compensation of any kind. The following are considered cases of force majeure: fire, flood, earthquake, weather events with consequences, or any other accident causing the complete or partial destruction of the company, its stock or supplies, or the shutdown of its operations; strikes and lock-outs, regardless of whether the movement was started by employers or workers; lack of motive power or raw materials resulting from a general cause, such as the halt of transport, any damage during sea or air transport, any transport delay due to unfavourable or impassable weather conditions, power cuts, engine breakdowns; any other cause suspending work on the order production chain, wherever it occurs and without it resulting from the will of the seller. The events referred to in the previous paragraph are also treated as cases of force majeure when they occur either at the supplier of raw materials essential to the manufacture of the goods ordered, or in any other establishment on which the performance of the contract depends, proof having to be given, in both cases, that the company concerned was actually stopped by the events in question.

Accordingly, and in accordance with the provisions of the French Intellectual Property Code, only personal use is authorised. Any other use constitutes infringement and is punishable under intellectual property law, unless prior authorisation has been given by Un Chat dans l’aiguille.
